Starting rules
> All payments will be through invoicing an in GBP (£) only. This is to retain legal rights and have protection against fraud, scandals, ect.> For future preferences, transaction up to £250 pounds or less are paid in full upfront. Anything higher can be paid in instalments. (More about the details of pricing down below.)>If full references arent supplied, commission will be counted as a design commission. This will be more expensive due to more work on my part (figuring out details, sorting out colour references, getting the right species, ect.). Preferably, reference art should not be very pixelated, as it would make it harder to deduce details from said work. Again, failure to provide full reference of your character (especially if its not from a media I can search up), will result in extra cost of your commission.!!: Comissioned works will usually be posted on my social medial unless you specify otherwise. I will try to ask if you dont want your work shared first to be sure, but please keep this in mind! I can also refer to you as anonymous if you still wish me to post the artwork.

-Humans/People (Not as confident! But I do still offer to draw people)
-Moderate injury, blood and gore (No organs/guts, or major gore like extreme skin flaying or dismemberment however.)
-Simple Weapons, machinery, armour, accessories (To some degree)
will not draw: ✕
-NSFW/ Fetish work
-Machines/ Heavy armor
-Mecha/ Transformers
-Excessive gore (Heavy organs and guts, dismemberment, ect.)
-Anything offensive (Wether that be obvious things like racism, homophobia, incest, pedophilia, or non obvious things like offensive subjects in media/shows/ games or movies)
-Art in another artists style
(Anything that I'm uncomfortable with wont be drawn, but please ask if you're unsure about something)
Disclaimer
-By commissioning/ buying from me , you automatically agree to the stated conditions as well as my public rules.
-Please read this with care to its entirety. I can refuse your commission for any reason, especially if you do not agree to these terms.
- If you do not comfortable with my TOS and/or aren't willing to agree to the conditions, you can decide not to commission me.
- Clients are not permitted in any circumstances to use any part of commissioned work from Chocolatestrawbs (e.g images, goods, and copies of goods) in any block-chain related tech including NFTs, cryptocurrency, or future inventions in the space. Any aspect of work by Choclatestrawbs must not be used to train, validate, or test any neural network or artificial intelligence (AI). Doing so is in violation of terms against alteration and external non private use of assets created for patrons.-All of my sales are “Digital Artwork”. Nothing is ever intended to be physically shipped by either me or the Client.USER AGREEMENTBy commissioning me, you agree that you have read, accepted and understood all the terms described.You agree here to the policy of using the art for personal, non-profit purposes unless otherwise stated, and provide all image credits to me.
Violating this will lead to being added to a blacklist indefinitely and without warning with any additional appropriate actions taken.
Process
ORDERING
- When you want commission me, you will have to fill our a request form. My commissions will always be clear to see if they're open or closed.
-Information I commonly ask for is:
--References/ Detailed description of the character(s)
--Mood of image
--Type of background
--Email address for invoice
--And much more which will be in the form.
-When I approve you commission, I will send you an invoice, and if you approve this invoice, I will begin work on your commission as soon as possible.
-Depending on the commission type, I may send you a more cleaned up sketch to approve of before moving onto the line art. I will always aim to send WIPs often during the work. If requested, I will show more WIPs of the progress. You may ask for a work-in-progress at any time.-Revisions go as follow: During the SKETCH phase, you can have one revision comprised of four edits (whether major or not), then during the COLOURING/ SHADING phase you can have one revision compromised of two edits (minimal edits only). Any more than that and extra charges may apply.Complexity fees may apply depending on the character, please keep this in mind when commissioning me. (Up to %30)PAYMENT
- Payment is paid upfront
- I am not responsible for any mistakes that is made on your part over the course of the transaction.
- I only accept GBP via Paypal as payment. You are responsible for making currency conversions.
-It is expected that you deposit the full price of the commission upfront unless stated otherwise before I start sketching/ The sketch will be sent to you.
-Transactions will be initiated by me to avoid accidental transactions. Please do not send me any kind of payment until I have confirmed that I can accept your commission and have asked for payment.
-Commission should be done sometime within a week to a month after the rough sketch depending on the type of commission, commission type, contact with commissioners, and life in general. Considering I am currently in education, larger commissions may take longer than a month to complete.
-Although I cannot guarantee that Ill finish your commission on a specified deadline, I will definitely try my best to meet any reasonable time frame you have in mind.
-You cannot change what you want your commission to be after approving the thumbnail sketch and sending payment. However, I can do revisions. (More written above.)
If you exceed more than the stated edits to a piece, I may charge an extra fee before continuing.
IMPORTANT: I do NOT offer full refunds unless the work was not done. But if you feel unsatisfied with the final piece, I can offer a partial refund (Up to 20%) or slight remake if the price is over £250)
Designs/ Adoptables
- I am allowed to post my designs and adoptables on my portfolio, social media and commission info.
-I'll ask you to send me your paypal email after confirming your purchased claim on a character whether that be via email, Discord, twitter, Deviantart, ect.
-Holds are not allowed under any circumstances.
-Payment expected upfront. If payment isn't received within 24 hours after I respond to the purchase claim the adopt will be put up for sale again.
-After purchase has been cleared you'll always receive a full resolution image(PNG) file of the adopt with background, transparent background and no watermark.
- The buyer owns the character, however I retain the right to create species and do designs with similar but still unique attributes.
-I remain the right as the original designer. You can add yourself as an additional designer if you have made big changes to the character such as a new character sheet/ added scars/ permanent accessories/ etc.
- I will never revoke ownership of designs once the design has been fully paid for. (No chargebacks or partial payments.)RESSELLING/TRADING/GIFTING-Reselling is allowed
-Like before, all payments will be through invoicing an in GBP (£) only.
-Trading is allowed however you may not trade (or resell) an adopt you received for free. (i.e: as a gift)
-Gifting is allowedOWNERSHIP-As the design creator, I retain all legal rights to my designs. For this reason, my adopts are for non-commercial use only unless you purchase separate commercial use fee from me. (e.g profit including but not limited to games, books , art pieces, merchandise, comics, t-shirts, mugs, banners, etc.) (+150%)
-Once you buy the adopt it's yours to use as you please for non-commercial purposes. What you do with the adopt is none of my concern as long as you credit me as the original creator of the design and follow my T.O.S-You may not make twins/triplets/quadruplets/quintuplets, etc of the bought adopt. One adopt stays one adopt.

Note, full price must be paid fully by the end of the commission once its completed. Or else full file wont be sent.
Terms of usage
- As a reminder Clients are not permitted in any circumstances to use any part of commissioned work from Chocolatestrawbs (e.g images, goods, and copies of goods) in any block-chain related tech including NFTs, cryptocurrency, or future inventions in the space. Any aspect of work by Choclatestrawbs must not be used to train, validate, or test any neural network or artificial intelligence (AI). Doing so is in violation of terms against alteration and external non private use of assets created for patrons.-All of my sales are “Digital Artwork”. Nothing is ever intended to be physically shipped by either me or the Client.
-Commissions are for personal use only. Artwork may be used as profile pictures/banners, but may not be used for profit unless the fee for commercial rights is paid.-Reposting and sharing the art is always welcome! However, credit to me is appreciated and should be clear.-In the case of an adoptable, you retain the rights to the character design.-I reserve the right to sign and/or watermark my own work. I will send you a full resolution image (by email or via google docs), but my signature will remain on both the full resolution and smaller versions of the Artwork.-I retain all copyright over my work, which includes the right to redistribute, reproduce, or use the image as a sample for sales or self-promotion unless otherwise agreed upon. In the case of a Public Commission, I may do whatever I wish with the art (eg. post it to other sites such as Twitter) but proper credit of your ownership to the character’s design will be given.-In the case of a commission, I will not claim the rights to a character design unless it was one of my own designs. Therefore I will not reuse/resell the Artwork for personal or commercial projects unless agreed upon.-In the case of an adoptable design, I will not reuse/resell the rights to the design once ownership is transferred to you, the Client. You retain all rights to the character of any design purchased from me, whether it is a custom or adoptable. However, I still retain the rights to the original artwork I’ve created. That means you cannot use the artwork I created for commercial purposes (like merch or prints) unless otherwise agreed upon (i.e the commercial fee is paid).
What you can do with the design:
--Upload the artwork to your personal websites/galleries.
--Use the artwork for anything you wish (original stories, roll plays, etc.)
-You can resell the design for whatever price you feel it is worth (I have no requirements on how much you can resell it for).
-If any rejected concepts are made, I have the right to keep or resell said concepts if they are not claimed by the client. (There is an extra fee for claiming more than one concept.)
